1. About These Terms

These Terms of Service govern access to and use of Melbourne Tutoring Services, including the website, booking tools, messaging, and related marketplace services. By creating an account, booking, listing tutoring services, or otherwise using the platform, you agree to be bound by these Terms.

2. Marketplace Provider and Aggregator Role

Melbourne Tutoring Services is an information provider and aggregator marketplace that connects students and parents with tutors. We facilitate introductions and bookings.

We do not provide tutoring services ourselves, and we are not a school, registered training organisation, or educational institution. Tutoring services are provided by tutors directly to students and parents.

3. No Employment Relationship

Tutors are independent users and independent contractors of the platform. Tutors are not employees, partners, agents, representatives, or franchisees of Melbourne Tutoring Services.

Nothing in these Terms creates an employment, agency, partnership, joint venture, or fiduciary relationship between Melbourne Tutoring Services and any tutor.

4. Eligibility and Minors

Users under 18 years of age may only use the platform with parent or legal guardian consent and supervision. Parents/guardians are responsible for decisions about tutor selection, session location, and in-person safety.

5. In-Person Safety, WWCC Duty, and Liability Shield

For in-person tutoring, the parent/student accepts and agrees that identity, credential, and safety verification are solely their responsibility.

  • The parent/student must verify the tutor's identity before the first in-person session.
  • The parent/student must verify the tutor's valid Working With Children Check (WWCC), or state/territory equivalent (including Blue Card in QLD and Ochre Card in NT), before any in-person tutoring begins.
  • Parents/students should inspect physical or official evidence of the check and ensure it is current and valid.
  • Sessions must take place in a safe, public, or appropriately supervised environment.

Melbourne Tutoring Services does not supervise in-person meetings and is not liable for conduct, misconduct, injury, assault, harassment, theft, property loss, or any incident arising during or in connection with in-person sessions.

6. Tutor Information and No Academic Guarantee

Tutors are responsible for the accuracy and legality of information they provide, including qualifications, experience, and checks.

Melbourne Tutoring Services does not guarantee specific academic outcomes, exam results, admission outcomes, or educational performance improvements.

7. Disclaimer of Warranties

To the maximum extent permitted by law, the platform is provided on an as-is and as-available basis. We do not warrant uninterrupted access, error-free operation, tutor suitability, or the completeness/accuracy of tutor-provided information.

8. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any non-excludable rights or guarantees under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where permitted by law, if liability cannot be excluded, our liability is limited to one or more of the following at our option:

  • Re-supplying the relevant platform service.
  • Paying the cost of re-supplying the relevant platform service.
  • Refunding the relevant platform fee paid.

9. Disputes Between Tutors and Students/Parents

Disputes concerning lesson quality, attendance, cancellations, payments, behaviour, or outcomes must be resolved between the tutor and the student/parent directly.

Melbourne Tutoring Services is not an arbitrator, tribunal, mediator, or guarantor of tutoring services and has no obligation to determine private disputes.

10. Limitation of Liability

To the extent permitted by law, Melbourne Tutoring Services is not liable for indirect, consequential, special, or incidental loss, including loss of profit, opportunity, reputation, or data.

11. Mandatory Active Consent Wording

The required booking/sign-up checkbox wording is:

[ ] I have read and agree to the Terms of Service and Privacy Policy. I acknowledge that for in-person tutoring, it is my responsibility to verify the tutor's Working With Children Check (WWCC) or relevant state equivalent and ensure a safe, supervised environment.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and appellate courts from them.
